Your Constitutional Rights Regarding
Signature Gathering
While we still have the Bill of
Rights and the First Amendment, we have the right to collect signatures and
leaflet in places that the public is allowed to go such as malls and shopping
centers. Some malls and shopping center managers are under the impression
that because their businesses are on private property, they are above the
US Constitution regarding free speech. As private property owners, they
have rights but they CANNOT prevent you from leafleting and
gathering petition signatures. The attached documents include a letter
from both the Twin Cities Police Department and from the Marin County District Attorney's
office that instructs police officers not to interfere or arrest those
engaged in legal free speech activities. This document should be in the
presence of all who are engaged in this type of activity. SJCM members
have used this document to immediately stop harassment from police, store
owners and shopping center managers. Click
